Interested Persons in Minnesota
Guardianship & Conservatorship Law
Interest persons, both in guardianship and conservatorship law and probate law, are those who are not necessarily directly involved in the proceedings but who may be directly or indirectly affected by the outcome of hte proceedings. Of course, interested persons also do include everybody directly involved in the proceedings.
If you are ready to hire a lawyer, please call me, a Minnesota guardianship attorney.
In guardianship and conservatorship law in Minnesota, interested persons are statutorily defined, with discretion granted to the court to grant additional interested person status.
The first, and perhaps most, interested person is the respondent to the proceedings. In guardianship proceedings, the respondent is the ward or proposed ward. In conservatorship proceedings, the respondent is the protected person or the proposed protected person.
Other interested persons include the nominated or appointed guardian or conservator; the legal representative of an interested person; the spouse, parents, adult children, and siblings, or next of kin, of the respondent; an adult who has lived with the respondent for more than six months; the attorney for the respondent; a governmental agency providing benefits (or to which an application for benefits has been made); a health care agent or proxy appointed by a health care directive; and, as noted above, any other person the court determines and designates as an interested person.
